TERMS and CONDITIONS
Purpose
These terms and conditions govern the sale of the products presented on this site by
the company: SUAD SARL
and
everyone visiting or buying products on the internet website www.areyousuad.com, hereinafter « net surfer ».
The following terms and conditions define the distant sale modes between SUAD and the net surfer from order to delivery. They settle all the necessary steps to order and ensure the follow up of this order between the two parties involved.
Ordering implies unquestionable acceptance to the terms and conditions. These conditions can be submitted to changes and the conditions applying are the conditions presented on www.areyousuad.com when the order is placed.
The net surfer declares:
- to be able to conclude the following deal, meaning having the legal majority in age and not being tutored
- to not proceed on buying suad products having for intention to sell them back.
Article 1 : Products
The products sold by SUAD are the products being on display on the website www.areyousuad.comwhen the net surfer browse the website.
Products are sold within the limit of available stock.
Products sold are described and presented with as many accuracy as possible. However, if mistakes or missing information were to be found, SUAD responsability could not be engaged. Pictures and texts describing the products only have indicative value and do not enter the contract area.
Article 2 : Prices
Prices are presented in euros (€) all taxes included, including VAT and are understood without delivery fees which remain to be paid by the net surfer unless special conditions.
Indicated prices include VAT rate when the order is placed. if VAT rate were to be modified, the changes could affect products prices without pre-notice to the web user.
SUAD reserves itself the right to modify its prices at any time. Products will be charged on the current prices when the order is placed.
Article 3 : Order
Any order placed equals unquestionned and express acceptation of prices and decription of the available products.
The net surfer declares being aware and accepting with no question the following terms and conditions before ordering. To validate the order thus equals the terms and conditions acceptation.
In order to allow the net surfer to get back on his or her order before fully validating it, SUAD created validation and acceptation screens. The order will only be completely registered when the last screen of payment validation (by credit card or check) will apear and be validated. From the last click for acceptation, the order is considered as definite. An email will be sent as soon as the order is registered. This message confirms that the order has been taken in consideration but does not ensure that the product is available.
Article 4 : Payment
Payment can be processed either online by credit card, either by bank transfer or cheque. The invoice will be inserted in the package with the ordered product.
In case of a gift order, the invoice will directly be available for the buyer in his personnal account (an order sheet without price indication will accompany the product).

The account will only be charged for the ordered and indeed sent products.
Bank transfer payments throughout Europe:
In case of a bank transfer, the payment should be organised by a bank being hosted in Europe. The payment should be confirmed on the bank account given as reference within 4 opened days after the order has been placed.
The order will be valid only once the cheque is received and checked
Article 5 : Credit card anti-fraud actions
SUAD reserves the right to check personal information provided by a customer and to take necessary follow-up action (such as asking for further proof or cancelling the order) in order to be certain that the person whose bank account is debited is indeed the same person who requested the order and also to avoid any fraudulent use whatsoever of credit card information.
Article 6 : Shipping fees, delivery time and conditions
All our deliveries have delivery signature option.
Except in the case of force majeure, delivery dates are in accordance with stocks available, as indicated below. suad accepts no responsibility or liability for late delivery for any reason whatsoever. Therefore, no request for compensation of any kind can be claimed by a suad customer.
SUAD reserves the right to select the transporters and organises the transport. Transport risks are accepted by the customer, from the moment the order leaves the warehouse.
The web customer undertakes to check the packaging and contents of the parcel and undertakes to write down any problem on the delivery note provided by the transporter.
SUAD delivers orders within all the European Community: Germany, Austria, Belgium, Cyprus, Danemark, Spain (except Canary Islands, Ceuta y Melilla), Estonia, Finland, France, Greece, Hungaria, Ireland, Italy, Lettonia, Lituania, Luxembourg, Malte, The Netherlands, Poland, Portugal, Czech Republic, Great Britain (except the Channel islands), Slovaquia, Slovenia ans Sweden.
SUAD also delivers orders in Switzerland, Norway, Canada and USA (custom fees are to be taken in charge by the customer).

In case of a cheque payment, the order will only been treated when the check is received. Delivery times start then when the check is received.
Article 7 : Returns and exchanges
From the date when the order is received, the customer has 15 days to return the product. Passed these 15 days, delivered products will be considered as following the customer request and as accepted by the customer and SUAD reserves then itself the right to refuse exchange, credit note or refund.
The returned product shall not have been worn, shall be packed in its original package and, if sent back by mail, shall be accompagnied by its fully filled return form obtained by contacting us here.

Return fees are to be taken in charge by the customer
An email will be sent to the customer to inform him or her of the refund either by check or credit card, depending on how the order was first payed.
Article 8 : Guarantees
In case of a defective product, the client shall return it following the conditions described within Article 7 of these terms and conditions. Degradations caused by a wrong use of the product or by an external cause (such as non respect of the washing instructions) shall not count for garantee.
Article 9 : Personal data protection
Following the law n-78-17 from the 6th of January 1978 linked to files and freedom, the use of personal data collected on www.areyousuad.com have been declared to the « Commission Nationale de l'Informatique et des Libertés ». Conforming to the data protection act, the net surfer has the right to access, modify or challenge its personal data information by applying here or by sending a mail to SUAD SARL - Service Internet - 670 Chemin du Charrel - 13400 AUBAGNE FRANCE.
SUAD website uses cookies. Cookies are small pieces of information that are stored by your browser on your computer's hard drive. They indicate previous visit of the net surfer on the website www.areyousuad.com. Our cookies do not contain any personally identifying information, but they do enable us to provide features such as personalisation and to store items in your Shopping Basket between visits.

Article 10 : Intellectual property
Every single part of the suad web site, be it visual or audio, including the adjoining technology, is protected by authors property rights, brands and patents.
It is the sole property of the company SUAD.
Article 11 : Liability
As regards all stages of access to the site, of ordering processes, delivery or subsequent services, suad only accepts partial responsibility. suad cannot be held liable for any inconvenience or damages caused by the use of the internet network, such as a breakdown in the service, outsider intrusion, the presence of any computer virus or any event of force majeure, as legally defined.
Furthermore, suad declines all legal responsibility for any failure to comply with contractual obligations in the case of force majeure or unforeseen circumstances, including, but not as an exhaustive list, internal or external company strikes, fire, catastrophe, internal or external breakdowns, and any event in general that could affect the completion of an order.
Article 12 : Validity of contract
Should any of the clauses in the contract herewith be made null and void by a change in the law, regulations or a legal ruling, then this shall not affect the validity and adherence to the terms and conditions of sale as stated herewith.
Article 13 : Length of contract
The above stated conditions shall remain applicable during the whole of the time that online services are provided by the company SUAD.
Article 14 : Litigation
These tems and conditions are governed by and construed in accordance with French law. In case of a dispute, the net surfer and SUAD commit themselves to find out a amicable arrangement before any legal action.
In case of litigation, the French courts will have exclusive jurisdiction for any dispute under this agreement.
